Without question, international criminal law (ICL) has become a legal growth industry. Regional supranational systems, such as the European Union, are beginning to prepare a genuine supranational criminal law that may supersede the national jurisdictions. These efforts are still in their infancy, but along with the creation of the prosecutorial framework and measures like e.g. the European Arrest Warrant, EUROPOL or EUROJUST, the defence lawyers are preparing themselves for the new challenge. It is thus useful and necessary to cover these developments from the get go. This collection of cases and materials attempts for the first time to provide a compendium of the most important legal texts, relevant documents and cases, as well as explanatory commentary on the law of defence in international criminal proceedings by scholars and practitioners who have a wealth of relevant experience in the field. The book provides students in law school courses on international human rights law and ICL with the essential materials to understand the vital importance of an adequate defence in international criminal proceedings. Further, the text gives legal practitioners who may consider extending their field of practice to the international level a look at the diversity of the tasks they will encounter and prepare them for the legal culture shock inevitable at the international tribunals and courts. This book is available for classroom adoption.

Zagreb Prosecutors Suspect Sanader Of Fraud, Abuse Of Office And Founding A Criminal Organisation.

Austria has extradited one of Croatia’s most arguable statesmen.

Previous Croatian Democratic Union (HDZ) boss and Prime Minister Ivo Sanader was transferred from Salzburg to a jail in Zagreb, the Fed. capital of Croatia, yesterday evening (Mon). Sanader was put in custody in Salzburg last December. He had been in gaol in the Austrian city nonstop until yesterday. The arrest on the A10 Tauern motorway came straight after Croatia issued an international arrest warrant on the contested ex-prime minister.

Zagreb prosecutors suspect Sanader of crime, abuse of office and founding a criminal organisation. He is suspected of channelling millions of EU Bucks into the HDZ’s coffers to finance the party’s election campaigns. Sanader has denied any wrongdoing. He said he was assured to prove his innocence in court.

The former HDZ director surprised fellow party members, political rivals and the press by stepping down in 2009. Speculations have spiralled over the step as the glad-hander never argued his decision. Rumours his resignation may do with unlawful operations shortly emerged. While Sanader stressed he was a well off man when he entered politics, some newspapers claim his family expended large quantities of money on precious paintings and other luxury objects in the past years.

Sanader’s team of lawyers attempted tough to stop his extradition for months before giving in a few weeks gone. Reports have it that the previous HDZ chief did not wish to threaten Croatia’s likely EU Union (ECU) accession by holding up juridical techniques. Media in his homeland report that Sanader considers the ECU joining as much his lifetime accomplishment as Croatia’s membership in the North Atlantic Accord Organisation (NATO) which was finalised 2 years back. Sanader headed talks with ECU expansion decision-makers for the maximum of the complicated process before they exclaimed some weeks back that Croatia fulfilled all factors to take part 2013.

The trial against Sanader who wore his foot in a cast for some weeks after falling over in prison is predicted to take place soon or next year. His extradition occurred a couple of days after Austrian People’s Party (VP) Justice Minister Beatrix ordered it to be carried out. Procedures were delayed formerly thanks to his lawyers’ appeals, but also because of worries over whether Sanader could expect a fair trial in his homeland.

Ex-VP Chancellor Wolfgang Schssel described Sanader as a “professional legislator, a great politician and a private friend.” Schssel invited Sanader to the Vienna State Opera Ball and other highly visible events and additionally to his personal party. Sanader who is also close to former VP Foreign Minister Ursula Plassnik was visited by ex-Tyrolean VP Governor Herwig Wagon Staa in custody in Salzburg.

Sanader can be prosecuted in Austria as state prosecutors suspect him of money laundering using a checking account in Innsbruck where he studied. Prosecutors are also continuing inquiries against Sanader in association with the near collapse of Hypo Group Alpe Adria (HGAA). The previous Carinthian provincial bank had to be nationalised in 2009 over its immense losses. The bank prospered for years before getting entangled in debatable real-estate deals and dangerous investments in Croatia (Croatia real estate) and other states in Southeast Europe. Its lax lending policy in addition has been given the blame for its near passing. HGAA received hundreds of millions of Euros of supposed state aid to keep it alive. Its new bosses admitted they could not guarantee to get the bank into a condition enabling it to pay the full sum back one day.

Sanader asserted in one of the few interviews he gave after the highway arrest last December that a “witch hunt and a smear campaign has been going on in Croatia against my family and me.” He promised to appear “stronger than previously from all this.”

Speaking to the Salzburger Nachrichten newspaper in Jan, Sanader asserted witnesses were influenced and put under stress to pipe up in his disfavour. He claimed : “The state prosecution never analyzed these activities. Some other accused were guaranteed lenience or exculpations if they accuse me. This was a strategy of many months.”

The previous Croatian P. M. claimed there had been a “climate of fear” in his homeland, adding that all accusations against him were “politically motivated.”

Sanader warned : “In contrast to Austria or Germany, we haven’t managed to get over the emergency yet. There are 360,000 people out of work, foreign speculators keep acting reluctantly. We cannot pay back our obligations, our image worsened. The economy is in a condition of standstill.”

Asked who might have been masterminding the “campaign” he has been speaking of, Sanader accused his inheritor as PM and party leader, Jandranka Kosor. “Kosor fears I’d need to return to top-tier politics. She wants to prevent that whatever it costs.”, writes tagza.com.
